4 Steps to Take When Preparing for Divorce

We understand that preparing for a divorce involves more than just paperwork; it's a journey that requires emotional strength and practical readiness. Let's navigate these uncharted waters together with these four steps to help you prepare for your divorce:

1. Gather Financial Information:

Before diving into the divorce process, both you and your spouse need a clear picture of your financial situation. Florida courts now allow uncontested divorcing couples to waive the filing of the Family Law Financial Affidavit, which details personal and joint assets. The parties will still be required to exchange the affidavits, so it is best to still collect all relevant documents to make informed decisions about asset distribution.

2. Determine Incomes:

In the divorce process, understanding both you and your spouse's income is crucial. Whether you're a salaried employee or self-employed, providing recent paystubs, tax returns, or bank statements helps establish financial clarity. Depending on income level, choose between the Long Form or Short Form Financial Affidavit. If you are uncontested, the financial affidavit will not have to be filed, just simply exchanged with your spouse.

3. Find a Place to Live:

If you share a marital residence, decide if you want to stay or move out. Consider your ability to manage bills and, if applicable, the impact on children. Prioritize their well-being when making housing decisions.

4. Assemble Your Support Team:

Frequently Asked Questions

How long does a divorce take in Florida?

In Florida, an uncontested divorce can be finalized in as little as 3–4 weeks, while a contested divorce may take 6 months to over a year depending on the complexity of the case and the court's schedule.

Do I need a lawyer to get divorced in Florida?

While Florida law does not require you to hire an attorney, having an experienced family law attorney significantly improves your chances of achieving a fair outcome, especially in complex cases involving assets, children, or spousal support.

How is property divided in a Florida divorce?

Florida follows the principle of equitable distribution, meaning marital assets and debts are divided fairly — though not always 50/50. Courts consider factors such as the length of the marriage, each spouse's financial contributions, and future earning capacity.

What is the first step in filing for divorce in Florida?

The first step is filing a Petition for Dissolution of Marriage with the circuit court in your county. You'll also need to serve your spouse with the petition and financial affidavits. Consulting an attorney before filing helps ensure you protect your rights from the start.
