What Should I Consider Before Starting the Divorce Process?

Here is what we have called the 101 of divorce cases, starting with the general process you should consider:

General Litigation is the most common method of divorcing and used in most cases. This option is for those couples who might have more challenges coming to agreements. The good thing to know when litigating is that most matters eventually settle so that a trial is not necessary. However, when one side refuses to be reasonable, the judge assigned to your case will make these difficult decisions within the confines of the law.

Ms. Yaffa has over 26 years of litigating experience and is one of a handful of attorneys Board Certified Marital and Family Lawyers since 2001. The Yaffa team of qualified litigators is ready to get tough and take your case to trial when necessary and advocate the issues of your case to a settlement when possible.

This option is best for clients that likely will have difficulty getting their soon-to-be ex to come to terms and settle their differences. The court system is in place in these matters to assure that your matter is concluded even if it requires a trial (which more often is not needed).

Mediation is the process of coming together with a qualified Boca Raton family law lawyer. The mediator will help to bridge gaps and work with the parties and their respective attorneys on a compromise and iron out the details of a divorce agreement.

If you resolve your matter at mediation the agreement will be incorporated into an enforceable final judgment.

Mediation is best for clients looking to settle with their soon-to-be ex and feel that they have a good chance of working through differences in the formal process of mediation. Please note that even in a traditional litigation case, most judges and circuits require the parties to mediate.

Collaborative Divorce is another divorce option that is gaining popularity. It is sometimes referred to as conscious uncoupling.

The parties, together with their collaboratively trained lawyers, work as a team including “neutral” mental health and financial professionals that help to educate, support, and guide the couple to reach a balanced, respectful agreement and avoid a legal trial through court.

Most couples walk away from a collaborative divorce feeling positive about the outcome and some feel they have a better chance of having productive parenting discussions and tackling the other issues that may arise post-divorce.

This option is best for clients that have a good relationship with their spouse. Although they may be ending their marriage, these individuals understand the importance of leaving a marriage wanting to remain on somewhat peaceful grounds. They also desire the ability to start their post-divorce relationship in a more sensible and peaceful manner. While not for everyone, it is a great option and as said, gaining popularity. A divorce lawyer can help facilitate this process and help it go smoother. An experienced divorce attorney can help bring both sides together in case of conflict.

What is Limited Representation?

Limited Representation is available to those clients that may not need or want a lawyer to represent them on all aspects of their divorce but instead need an attorney to assist them on specific issues and will advise them when needed.

For example, a client may want us to handle the trial or a hearing for temporary relief or even come in to represent them at mediation. These are just a few of the limited issues that our lawyers can assist you with on a limited basis. This option is best for clients that have limited resources or have most issues resolved but need extra assistance to get them to the next step, such as for attorney fees and costs and or support such as alimony.

What Other Divorce Options Do I Have?

Your Divorce Law Group, powered by Yaffa Family Law Group is a DIY with Us Option is the latest addition to our services and for those who have mostly agreed on the main issues of their divorce but still want and need the advice and assistance of a divorce lawyer and a team of attorneys to guide them through.

These clients assist our Yaffa team in the completion of the necessary forms. Individuals are guided through the process by way of answering carefully thought-out, step-by-step questions.

Once the questions are answered and the forms created, the client meets with their assigned lawyer (and team) by telecommunication to answer questions, provide advice, and finalize all the documents necessary to have the client walk everything through to a final hearing and divorce. Or they can hire us to take them all the way through if they prefer.

These clients have reduced legal fees as a result of their efforts. These clients want to be guided but they have what are generally uncontested matters.

The DIY with Us option is best for clients both with and without children but who have agreed to the distribution of their assets and liabilities, support issues such as alimony and for those that have children have agreed generally as to timesharing, parental responsibility, and child support.

Our DIY with Us clients receive access to their own portal and app that will guide them step by step with assistance as they need to navigate them through. This is a great option for those that are eager to jump in, save the cost of a typically litigated divorce, and partner with us to get it done.

Should I Consult with a Divorce Attorney Before Moving Forward?

Consulting services are best for those clients that may not be ready to get divorced but who want to assure that they are planning and preparing and making decisions that are in their best interest, just in case.

Consulting is also a good option for clients that have decided to handle their divorce themselves and just want us to be there as they need help as to legal advice, drafting, and consulting on other levels behind the scenes.
